We’ve done everything we can to ensure that purchasing, reselling, and connecting with your favorite artists and events on our sites and apps goes as smoothly as possible.
Our site
Tixr is composed of multiple websites and apps (our "Site") that you can use on your computer or mobile device.
The following Terms of Use cover the general use of Site and the services we provide. These Terms of Use are supplemented by these additional policies and terms: Privacy Policy, Reseller Terms, Purchase Policy, Tixr Waitlist Terms of Service, and Tixr Rewards Terms of Service (collectively referred to as our “Terms and Conditions”). Continued use of our Site and the services provided constitutes your review and acceptance of the Terms and Conditions generally, and each of the component policies and terms.

Our role
We love music and events as much as you do, but we’re not promoters or artists. Instead, we provide an awesome platform which sells tickets and collects payments on behalf of artists, venues and basically anyone who is authorized to sell tickets (“Event Organizers”), and other users of our Site who advertise their tickets for resale (“Rellers”).
To be clear: we are NOT directly involved with the operations of an event. This means, among other things, that we have no influence on the quality of the event (e.g., if it sucks), the decision to modify an event in any way (e.g., if the date or the lineup is changed), or the enforcement of the Event Organizer’s rules (e.g., kicking you out for forgetting to wear shoes).
If you are unhappy with the event itself, you’ll need to take the matter up directly with the Event Organizer who can address your concerns and issue refunds, at their discretion. You can always reach out to Tixr Support to find the best contact for the Event Organizer. In essence, what we are saying is: by using our Site, you agree not to bring any claims against us for any potential issues you may have with an Event Organizer’s terms or services. If you are a consumer residing in France, additional consumer terms apply—see the “French Consumer Addendum” below.
Registration and communication
Our registration process is designed to make purchasing or reselling your tickets as easy as possible.
Please see our Privacy Policy to learn about all the ways we protect your privacy and keep your data safe.
All activity on your account is your responsibility. Do not use another user’s account without explicit permission. If you see any unauthorized activity on your account, please contact us immediately at Tixr Support.
All correspondence to and from Tixr is handled first by email and satisfies any legal requirement that our communication with you be in writing.
Conduct
Our Site requires reasonable common-sense conduct from our users to keep running smoothly. The basics:
- You have to be real—not a robot or part of any commercial service looking to use Tixr for resale of tickets on the secondary market. This includes putting an unreasonable load on our system or requesting more than 1,500 pages of our Site during any 24-hour period.
- You have to be who you say you are. Your IP should not be concealed and your username should not be used to impersonate another individual. Usernames should not be obscene or otherwise offensive.
- Don’t try to hack into the Site to circumvent our security measures, including our CAPTCHA, or to get unauthorized access to other users’ accounts.
- Don’t deploy any malware, spamming, or flooding that would interfere with other users’ experiences on the Site.
- Don’t download, export, reverse engineer, or create derivative works of any content on our Site.
- Don’t frame or mirror the Site, or use any spider, robot, or automated tool to index, dateline, or reproduce content or user behavior on the Site, unless you have written authorization from Tixr to do so.
- Don’t use our Site to transmit or upload material that would infringe upon others’ rights or privacy, intellectual property, or publicity.
- Don’t use a password or code (pre-sales or otherwise) to get access to the Site if you aren’t the intended recipient of that password or code.
- Don’t make any copy or counterfeit reproduction of our tickets.
- Don’t seek a dispute or “chargeback” from your credit card company for a valid purchase. If you do, your tickets may be canceled, and in the future we may refuse to honor that credit card and/or block the accounts of people who use that card.
Security
We use the best security measures possible to safeguard our systems, and to ensure the security of your data. However, the Internet is never 100% secure. You should take the steps you can to protect yourself from identity theft.
Never share your passwords. We, therefore, assume no liability for any problems that arise from the interception and misuse of information on our sites and apps.
Termination of services
We definitely want to stick together—but at the end of the day this is our Site, and we’ve got to keep it running under what we believe are reasonable terms of service. This includes reserving the rights, without any liability to you or a third party, to modify, suspend, or discontinue any part of this Site at any time, with or without notice to you.
There are two ways for us to part:
- You break up with us. If you decide you no longer want to have a Tixr account, or if you no longer agree to our terms of service, you can cancel your account at any time. To cancel, contact Tixr Support.
- We break up with you. If we find that you’ve been violating our any part of our Terms and Conditions, rules of conduct, or any other policy or terms and conditions of our Site, we reserve the right to cancel your account. If so, we’ll notify you of our decision by email.
Sweepstakes and contests
Tixr puts together fair and straightforward rules for all sweepstakes and contests we or our third-party partners hold on the Site. The rules will be posted with each promotion. Please read the rules carefully before you participate.
Links
Tixr’s Site may contain links to other websites that are not under our control. We are not responsible for any other website’s content. By linking to it, we are not implying any sort of endorsement or guarantee of that website or its operators.
Advertising
The prices advertised on our Site and in our marketing material may not be the prevailing price on the day the material is circulated.
Claims of copyright infringement
All content on our Site is either property of Tixr or licensed property from our partners and is fully protected by intellectual property laws. All registered and unregistered trademarks, logos, copyrights, and service marks may not be used without our prior written permission.
If you believe that anything displayed on our site is in violation of your intellectual property rights, please notify Tixr via Tixr Support and we will review the issue promptly.
Under the age of 13?
Tixr is not intended to be used by anyone under the age of 13. If you are a legal guardian of a child under 13 who may have given us information, you can contact us at Tixr Support with your COPPA Information Request.
Modifications
Check the Tixr website to ensure that you are viewing the latest version of this agreement. We may change our Terms and Conditions, and individually any of our Terms of Use, Privacy Policy, Reseller Terms, Purchase Policy, Tixr Waitlist Terms of Service, and Tixr Rewards Terms of Service from time to time.
Limitation of liability
If you purchase a ticket with us, you assume all risks associated with attending the event, including but not limited to the risks of inclement weather, and waive any claims for personal injury or deaths against us. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law. If you are a consumer residing in France, this section applies only to the maximum extent permitted by French law.
Our Site is provided on an “AS IS” and “AS AVAILABLE” basis. Use of our Site is also at your own risk and you agree to indemnify, defend, and hold us or our services partners, affiliates, successors, suppliers, attorneys, and advertisers, harmless from any liability, loss claim and expense, including attorney’s fees, related to (a) your violation of the Terms and Conditions and/or (b) the accuracy, content, completeness, legality, and reliability of the information accessible on our Site.
THE INFORMATION, SOFTWARE, PRODUCTS, AND SERVICES INCLUDED IN OR AVAILABLE THROUGH THE SITE MAY INCLUDE INACCURACIES OR TYPOGRAPHICAL ERRORS. CHANGES ARE PERIODICALLY ADDED TO THE INFORMATION HEREIN. TIXR, INC. AND/OR ITS AFFILIATES MAY MAKE IMPROVEMENTS AND/OR CHANGES TO THE SITE AT ANY TIME.
TIXR, INC. AND/OR OUR AFFILIATES MAKE NO REPRESENTATIONS ABOUT THE SUITABILITY, RELIABILITY, AVAILABILITY, TIMELINESS, OR ACCURACY OF THE INFORMATION, SOFTWARE, PRODUCTS, SERVICES, AND RELATED GRAPHICS CONTAINED ON THE SITE FOR ANY PURPOSE. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL TIXR, INC. AND/OR OUR AFFILIATES BE LIABLE FOR ANY DIRECT, INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL DAMAGES OR ANY DAMAGES WHATSOEVER INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS, INJURY, CLAIM, LIABILITY, LOSS OF USE, DATA, OR PROFITS, ARISING OUT OF OR IN ANY WAY CONNECTED WITH THE USE OR PERFORMANCE OF THE SITE, DELAY OR FAILURE IN PERFORMANCE BEYOND OUR CONTROL, WITH THE DELAY OR INABILITY TO USE THE SITE OR RELATED SERVICES, THE PROVISION OF OR FAILURE TO PROVIDE SERVICES, OR FOR ANY INFORMATION, SOFTWARE, PRODUCTS, SERVICES, AND RELATED GRAPHICS OBTAINED THROUGH THE SITE, OR OTHERWISE ARISING OUT OF THE USE OF THE SITE, WHETHER BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE, EVEN IF TIXR, INC. BECAUSE SOME STATES/JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, THE ABOVE LIMITATION MAY NOT APPLY TO YOU. IF YOU ARE DISSATISFIED WITH ANY PORTION OF THE SITE, OR WITH ANY OF THESE TERMS OF USE, YOUR SOLE AND EXCLUSIVE REMEDY IS TO DISCONTINUE USING THE SITE.
TIXR AND ITS PARTNERS’ AND AFFILIATES’ AGGREGATE LIABILITY IN CONNECTION WITH ANY CLAIM ARISING OUT OF OR RELATING TO THE APPLICATION OR SERVICES SHALL NOT EXCEED $100, AND THAT AMOUNT SHALL BE IN LIEU OF ALL OTHER REMEDIES THAT YOU MAY HAVE AGAINST US.
ANY CAUSE OF ACTION YOU MAY HAVE WITH RESPECT TO THE APPLICATION AND SERVICES MUST BE BROUGHT BY YOU WITHIN ONE (1) YEAR AFTER THE CAUSE OF ACTION ARISES OR BE FOREVER WAIVED AND BARRED.
Arbitration and disputes
IMPORTANT NOTICE FOR CONSUMERS RESIDING IN FRANCE: If you are a consumer habitually resident in France, this “Arbitration and Disputes” section does not apply to you.
Instead, the “French Consumer Addendum” below governs dispute resolution, including consumer mediation and competent courts.
Disputes or claims relating to your use of our Site or any products you have purchased from our Site or resold on our site shall be finally resolved through binding arbitration.
The arbitration will be before a single arbitrator conducted in the county and state of your billing address, in the English language, and in accordance with the United States Arbitration Act and the Supplementary Proceeds for Consumer-Related Disputes then prevailing of the American Arbitration Association.
You agree that the arbitrator, to the full extent of the law, may not consolidate claims from any other party, and that the dispute resolution will be conducted on an individual basis, not in class, consolidated, or representative proceedings. Further, by agreeing to arbitration you waive any right to a jury trial or to participation in a class action.
If this specific provision is found to be unenforceable, then the entirety of this arbitration section will be null and void and neither party will be entitled to arbitrate a dispute.
The arbitrator’s award shall be binding and may be entered as a judgment in any court of competent jurisdiction. In the event you are the prevailing party, Tixr shall pay your attorney’s fees, if any.
To begin an arbitration proceeding, you must send an email requesting arbitration and describing your claim to Tixr Support.
Exemptions to arbitration include:
- If you have violated or threatened to violate Tixr’s intellectual property rights, wherein Tixr will seek injunctive or appropriate relief in the State of California, and you consent to exclusive jurisdiction and venue in such courts.
- You and Tixr retain the right to pursue any claim in small claims court located in the county and state of your billing address that is within the court’s jurisdiction and proceeds on an individual, non-class basis.
Completeness
The Terms and Conditions contain the entire understanding and supersedes all prior understanding of the parties hereto relating to the subject matter hereof, and cannot be changed or terminated orally.
If any provision of the Terms and Conditions is found to be illegal or unenforceable, the Terms and Conditions will be deemed curtailed to the extent necessary to make it legal and enforceable and will remain, as modified, in full force and effect.

French Consumer Addendum
1) Scope
This Addendum applies only if you are a “consumer” (as defined under French consumer law) and are habitually resident in France, and you use Tixr services that are directed to the French market. For the avoidance of doubt, consumers within this scope are hereinafter referred to as “French Consumers”. In case of conflict between this Addendum and any other part of the Terms and Conditions, this Addendum prevails for French Consumers.
2) No right of withdrawal for dated leisure events
In accordance with Article L.221-28 of the French Consumer Code, tickets for leisure activities to be provided on a specific date or during a specific period (including event tickets) are not subject to a right of withdrawal.
3) Cancellation and postponement
If an event is cancelled by the Event Organizer without a new scheduled date, any refunds shall be handled in accordance with the refund policy of the Event Organizer. Any treatment of fees (e.g., booking or delivery fees) will be as described at checkout and/or in the applicable Purchase Policy, subject to mandatory law.
If an event is postponed/rescheduled, ticket validity and any refund conditions are determined by the Event Organizer and will be communicated to you.
4) Ticket resale
French law restricts the habitual resale or offering for resale of tickets without authorization from the producer/organizer/rights holder. If you resell tickets, you must comply with applicable French law and any Event Organizer restrictions displayed at purchase and/or in the Reseller Terms.
5) Complaints and consumer mediation
Before pursuing any legal action, you agree to first contact Tixr Support to seek an amicable resolution.
If your dispute remains unresolved after a written complaint, you may be able to report the issue to a consumer protection authority or dispute resolution body relevant to your jurisdiction or the merchant's location. These organizations often assist with cross-border e-commerce disputes and can provide guidance on your rights and next steps.
6) Applicable law and courts
This Addendum and French consumer purchases are governed by French law. In the absence of an amicable resolution (including mediation where applicable), disputes may be brought before the competent French courts.
7) Limitation of Liability
If you are a consumer habitually resident in France, this Section applies to you and prevails over any other limitation or exclusion of liability in these Terms.
- Tixr’s liability for its own services. Tixr is liable for damage directly caused to you by a proven breach by Tixr of its obligations under these Terms (including the provision of the online ordering interface, payment processing services where applicable, and ticket delivery tools), in accordance with mandatory French law.
- Event Organizer responsibility. The Event Organizer (and not Tixr) is responsible for the organization and performance of the Event (including venue rules, postponement, cancellation, lineup changes, and the Event experience), except to the extent that such matters are directly attributable to Tixr or where mandatory French law provides otherwise.
- Foreseeable damages (contractual liability). To the extent permitted by mandatory French law, and for Tixr’s contractual liability, Tixr is only liable for damages that were foreseen or could have been foreseen at the time you accepted these Terms and/or completed the relevant purchase, unless the non-performance is due to Tixr’s intentional misconduct (faute dolosive) or gross negligence (faute lourde).
- No exclusion of mandatory liabilities/rights. Nothing in these Terms excludes or limits: (i) liability for death or personal injury caused by Tixr; (ii) liability that cannot be excluded or limited under French law; or (iii) your mandatory statutory rights and remedies as a consumer under French law.
8) Mandatory consumer rights
Nothing in the Terms and Conditions limits mandatory rights and remedies available to France consumers under applicable law.
9) Language
For French consumer purchases, Tixr will make the pre-contract information and applicable purchase terms available in French. In case of inconsistency, the French version prevails for French consumer purchases.
10) Legal Information
Tixr provides a SaaS ticketing platform and acts as an intermediary facilitating the conclusion of the ticket sale between you and the Event Organizer. Unless expressly stated otherwise on the checkout page, the Event Organizer is the seller of record and the supplier of the tickets and the Event services. Tixr’s role is limited to providing the online ordering interface, payment processing, and ticket delivery tools, and Tixr may receive a booking/service fee for these services as displayed at checkout.
Tixr is not the supplier/organizer of the Event and does not control the Event, its quality, its execution, or the Organiser’s rules. All ticket conditions and Event terms (including access rules, cancellations/postponements, and refunds) are set by the Event Organizer and apply to your purchase and attendance, subject to mandatory consumer law.
